Terms of Service

All products (cakes and other desserts) made by Sweet Sue Bakes are subject to the following Terms and Conditions.

HOME CONSUMPTION AND HOMEMADE FOOD ACT
All products are produced according to House Bill 181, Home Consumption and Homemade Food Act in the state of Utah. Products are processed and prepared without state or local inspection and are not for resale.

INGREDIENTS
1.  Products are prepared in a location that also handles common allergens including milk, soy, wheat, eggs, peanuts, tree nuts or other allergens. It is the responsibility of the Consumer to inform Sweet Sue Bakes, prior to the confirmation of their booking, of any allergy/intolerance issues. It is the responsibility of the Customer to inform their guests of all allergy/intolerance information, and accordingly, the Suppler will not be held liable for any allergic reactions resulting from consumption of the products.
2.  All specialty dietary products are NOT guaranteed suitable for allergies and are suitable for intolerances only
3.  All products are made to be eaten on the day of the celebration.

QUOTES
1.  All quotations are valid for five days from the date of issue.
2. In the event that the desired date has been filled by another order/customer, prior to the Customer confirming the booking, Sweet Sue Bakes is not obliged to honor the quote.
3.  All quotations are not bookings. All quotations are subject to availability.

ORDERS
1. Sweet Sue Bakes prefers at least thirty (30) days notice for all orders, as we are continually booked in advance. We will however, endeavor, where availability permits, to accept short-notice cakes.
2. Any products ordered from a picture or photo of a product produced by any other cake maker can only be reproduced by Sweet Sue Bakes as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.
3. The date of your final payment is the final date for any changes of size, style or flavors to a wedding cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

DEPOSITS
1. Wedding cake orders require a non-refundable deposit of $250 which holds your date at the time of booking within thirty (30) days in advance of your event.
2. Celebration cakes and other product orders require a non-refundable deposit of 50 percent to hold your date within fourteen (14) days prior to pick-up or delivery.
3. If Sweet Sue Bakes has delivered a product that is an accurate interpretation of what has been quoted and invoiced but the Customer does not accept the finished Product, the deposit WILL NOT be refunded. The Customer can choose to pay the remainder and take the Product(s), or leave them at no extra cost.
4. For items other than wedding cakes, if an order is placed within seven (7) days prior to pick up, a 75 percent deposit is expected within twenty-four hours of invoice. If order is placed withing three (3) days prior to pick-up, payment in full is required and due upon receipt.

UNFORSEEN CIRCUMSTANCES
1. Where Sweet Sue Bakes cancels the booking due to illness or any other unforseen circumstance that affects the ability to deliver the ordered Product, the deposit will be refunded within seven (7) days of notification to the Customer.
2. The deposit will be refunded via bank transfer only, and the customer will need to provide bank details to Sweet Sue Bakes. 

FINAL BALANCE PAYMENTS AND PICKUPS
1. Wedding cake balances are due ten (10) days PRIOR to wedding date.
2. Celebration cake and other product order balances are due on or before the pickup or delivery date, and before the Product or delivery personnel leaves the premises.
3. We must receive the balance by the due date indicated or contract is null and void, and deposit will not be refunded.
4. If paying by cash, correct change is appreciated, as no cash is kept on premises. Change will not be provided by Sweet Sue Bakes.
5. If paying by internet transfer (i.e., PayPal or Venmo), the money needs to clear (be in the account) BEFORE the product or delivery personnel leaves the premises.
6. If you or your representative elects to pick up and set up a Product, you assume all liability and responsibility for the condition of the Product once it leaves our possession. 

DELIVERY
1. Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed in appropriate condition, it is then up to the Customer to store and care for the products as per Sweet Sue Bakes' instructions. If anything is to happen to the products after this exchange and deemed to be the fault of the Customer through not following the instructions provided, Sweet Sue Bakes is not liable for any damages.
2. The Customer is responsible for providing an appropriate and secure table and environment for the Products. Cakes are heavy and require a sturdy table, and optimal room temperature of 72 degrees Fahrenheit or below.
3. A delivery date and time will be agreed upon by both parties, and if the Customer is not at the location at this time and date, and Sweet Sue Bakes is not able to contact the Customer, the product will be transported back to Sweet Sue Bakes and it will be the Customer's responsibility to collect the product at the time that suits Sweet Sue Bakes.
4. Delivery and setup costs are depending on the location of the venue and will be stipulated in the invoice.
5. If flowers are provided by an outside source, Sweet Sue Bakes will place them. The Customer acknowledges that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

PUBLICATION
1. Sweet Sue Bakes reserves the right to use any image of a product made by us for publication at a later date without compensation to the Customer
2. Sweet Sue Bakes will endeavor to not post any photos on social media or other platforms until after your event has taken place.
3. Sweet Sue Bakes will never use any image that is supplied by the Customer, without first obtaining the Customer's permission (i.e., children's birthday parties and photos of the events).

RETURN OF RENTED EQUIPMENT
1. Deposits are taken for all equipment. All equipment must be returned on the agreed date or extra charges may be levied to cover costs. Any damages to equipment will incur a reduction of deposit returned in order to cover costs of repair or replacement.
2. Equipment rental price, deposit, and all other charges will vary depending on which item of equipment is being rented and in what condition and time frame it is returned by the Customer.

GIFT VOUCHERS
1. Any gift vouchers or flyers being redeemed will only be honored if the pickup/delivery date is within the expiration period of the voucher.
2. The voucher or flyer must be presented upon picking up baked foods, otherwise, the items cannot leave the premises. The voucher must be surrendered upon pickup of baked goods as it will be treated like cash.

DAMAGE
It is the responsibility of the Customer to check the state of the product before leaving the premises. Once the item has left the premises, the Customer has accepted the item as is and is responsible for ensuring that the product(s) gets to its destination safely and is stored as per instructions from Sweet Sue Bakes to achieve best results for taste and quality and to avoid any damage. 

THIRD PARTY PICKUP
If a third party will be collecting the cake on the Customer's behalf, this party will be given all appropriate information that would have been given to the customer. Same conditions apply as if the customer were to collect themselves.

SERVING SIZES
Celebration cake serves are based on a size of 2" X 2" X 5" high. Wedding cake serves are based on a size of 1" X 2" X 5" high. Cake serving sizes are estimated. Specialty cakes, carved cakes, and the method of slicing may affect the ultimate serving number. The Customer understands and accepts these terms and must order their products accordingly after having considered these variables.

POSTPONEMENT
If for any reason the event is required to be postponed, please contact Sweet Sue Bakes immediately. The new date proposed will be subject to availability. 

CANCELLATION/REFUNDS
If cancellation of the order is required and you have paid your full balance, the refund policy is as follows:
1. If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less the cost of any supplies already purchased for your products.
2. If the cancellation is less than seven (7) days prior to your event, there will be no refunds given.
3. Refunds will be paid within thirty (30) days of the cancellation.
4. The monies, if owed, will be refunded via bank transfer only, and the Customer will need to provide these bank details to Sweet Sue Bakes.

Please note: Any non-refunded balance may be credited toward future purchases at the discretion and availability of Sweet Sue Bakes.
